This Privacy Policy describes how Music Roadtrip (“Music Roadtrip” or “we” or “our” or “us”) treats certain information collected or provided in connection with an end user’s (“you” or “your” or “user”) use of Music Roadtrip’s website, https://www.musicroadtrip.com/, and any other website, social media pages, apps, or other digital medium owned or operated by Music Roadtrip (collectively, the “Site[2] ”). This Privacy Policy also applies to any Personal Information (defined below) collected, stored, or used by us in connection with the Services (as defined in our Terms and Conditions[3] ).
The information provided in this Privacy Policy is designed to inform you of the categories of Personal Information we collect and the sources from which we obtain it; how and why we use your Personal Information; when and with whom we share or disclose your Personal Information; how we use cookies, pixels, and similar technology; how we retain, secure, and protect your Personal Information; your privacy rights and choices, including how to access, correct, delete, or port your data (as applicable) and how to opt out of certain collection; and how to contact us with questions or requests. Definition of Personal Information
“Personal Information” is typically understood to mean any information that can be used to identify you, but may be more narrowly defined by applicable law or statute.
This Privacy Policy does not cover data we, or our authorized third-party vendors or partners, collect lawfully, information that does not or cannot be used to identify a particular individual, or deidentified, aggregate, or pseudonymous data.
Sensitive Personal Information
We may collect or process “sensitive personal information” (as defined under applicable state privacy laws), which may include: payment card information with access credentials and precise geolocation data We will not process sensitive personal information except where: (a) you have provided specific, opt-in consent; (b) such processing is strictly necessary to provide or maintain a product or service you have specifically requested; or (c) as otherwise permitted under applicable law. We will not use or disclose sensitive personal information for targeted advertising purposes.
Sources of Personal Information, Generally
We get most Personal Information directly from you, through the Site, or from transactions with you in connection with our Services. We might also obtain Personal Information about you from other Site users or other entities with whom we have contact. For example, we may obtain information through public records, or transactions you have with our authorized third-party vendors or partners, some of which may be deemed Personal Information. If you are sharing information with us about any other individual, you must obtain their consent.
Categories of Personal Information Collected
The categories of Personal Information we may collect from you include:

Information Collected Automatically
We may automatically receive and store certain types of Personal Information whenever you visit the Site, such as information from Google Analytics (see https://policies.google.com/privacy) on when, how often, and for how long you use the Site, information related to your geographic location, and the content you submit and view. This information may include the name of the domain and host from which you access the Internet and the IP address of the computer or device you are using. We may log and use your IP address to administer the Site, to help diagnose problems with our server, to analyze trends, to track users’ webpage movements, to help identify you and/or verify your use, and to gather broad demographic information for aggregate use. We may use standard tools, such as cookies or web beacons, to monitor the Site and Internet usage and to improve or customize the content on the Site. Pixels, Tags, and Advertising Technologies
Our website and emails use cookies, pixels[5] , tags, and similar technologies to understand how you interact with our content and to deliver and measure advertising. These technologies may be provided by us or by third parties, including social media and digital advertising partners such as Meta, Google, Spotify, Ticketmaster, Live Nation, and other advertising and/or analytics providers. When these pixels load, they may allow those companies to collect or receive information from our website and other online services (such as your IP address, browser details, pages viewed, queries made, and actions taken) and use that information to provide measurement services and target ads.
Log Data
Our web servers may collect log data, which provides aggregate and/or non-aggregate information about the number of visits to different pages on the Site. We use such log data to improve access to the Site based on visitors’ web browsers and operating system types to make the Site available to as many users as possible. We do not link the log data collected to Personal Information except as necessary to provide and/or manage our Services. Third party providers may also collect log data independently from us.
Our Usage of Cookies and Related Technology
What are cookies? Cookies are small data files stored on your browser or device, which can be in the form of session cookies (which expire once you close your web browser) or persistent cookies (which stay on your browser for a set period of time or until you delete them). Use, Retention, and Sharing.The data collected through tracking tools is retained only as long as necessary to provide and improve our services and is not sold or shared for third party advertising purposes.
California Users. We obtain opt-in consent before capturing any communications on our Website and Application in compliance with California’s Invasion of Privacy Act (Cal. Penal Code § 630 et seq.).
For opt-in jurisdictions: We do not activate these tools until we have obtained your prior, express consent through a banner click.
What are your choices concerning cookies? You have the right to choose whether or not to accept cookies. However, since cookies can be an important part of how our Services work, if you remove or reject cookies, this could affect the availability and functionality of our Services. Data Protection Assessments. Where required by applicable law, we conduct data protection impact assessments before engaging in processing activities that present a heightened risk to individuals, including targeted advertising, profiling, the sale or sharing of personal data, the processing of sensitive personal information, and the use of personal information for automated decision-making.
Automated Decision-Making Technology (ADMT)[7]
We may use automated decision-making technology, including algorithms, AI systems, or machine learning models, to process your Personal Information for certain purposes, including personalized recommendations. When automated decision-making technology is used to make decisions that produce legal or similarly significant effects concerning you, you may have the right to: (a) be informed that ADMT is being used; (b) access a description of the ADMT, including its logic and intended output; (c) opt out of such processing; and (d) request human review of the decision.
General Reasons for Collection and Use
We collect Personal Information to help identify you; to perform contractual obligations, including our Services and/or processing and fulfillment of orders; to communicate with you; to properly administer our Site and to maintain records; to research and analyze the use of our Site and Services so we can improve our Services; to detect and prevent fraud; to exercise and defend legal claims; to comply with legal obligations; and for other purposes as described in this Privacy Policy. This information may be shared with third parties, such as our advertising partners, to show you ads on other websites that match your interests. Protected classification characteristics such as age and gender are not collected intentionally but may be revealed in identity data or other information we collect and subsequently stored in our systems.[8]
Accounts, Profiles, and Preferences
Account Registration. For some aspects of our Site, you may need to or be able to register an account with us via our Site (“Account”) by providing certain Personal Information. In doing so, or in connection with our Services generally, you may need to represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use the Site. You may also need to provide a valid email address or add shipping and billing information to place orders. All information that you provide to Music Roadtrip or its vendors, agents, associates, or partners, including your payment card or financial account information, is subject to Music Roadtrip’s Privacy Policy or the respective third-party privacy policy. You may be able to update, correct, or delete information about you by logging into your Account and updating your profile information or by emailing us at info@musicroadtrip.com. If you wish to delete your Account or, under appropriate circumstances, any Personal Information that may have been collected, please email us at info@musicroadtrip.com, but note that we may require further confirmation procedures and necessarily retain certain information about you for legitimate business purposes or as required by law.
Personal Profiles and Preferences. We may also collect and maintain Personal Information about you to create a personal profile containing preferences and other information that you voluntarily provide to us. This information is used for improved functionality of and your interaction with our Services and not for third-party commercial advertising purposes. Examples of the types of information we may collect for this purpose include your first and last name, a valid email address, and geographic location or address. Additionally, we may use your email address to send confirmation of purchases and, if necessary, to contact you to help process a purchase. We may also use your email address to notify you about special offers, promotions, upcoming events, or matters that may be of interest to you.
Large Language Model / AI Training Disclosure
We do not use PI for LLM training: We do not use, sell, or share your Personal Information for the purpose of training large language models (“LLMs”) or similar generative artificial intelligence systems.
AI-Powered Tools and Automated Processing
We may use artificial intelligence (“AI”) technologies, including machine learning algorithms and automated tools, to personalize content and recommendations, provide customer support through AI chatbots, and generate content. These AI tools may process your Personal Information, including browsing behavior, purchase history, and interaction data, to provide and improve our Services. Where AI-based tools are used to make decisions that have legal or similarly significant effects on you, you may have the right under applicable law to: (a) be informed about the use of AI in the decision-making process; (b) opt out of automated decision-making; and/or (c) request human review of an AI-assisted decision. We may also use pixel tags and similar technologies from multiple advertising platforms (including, but not limited to, Meta, Google, LinkedIn, and TikTok) to track user interactions and serve personalized advertising across the internet.
Opt-Out Options
Consent and Opt-Out for Tracking Technologies. Where required by law, we will obtain your consent before using these technologies, and you can withdraw your consent or change your preferences at any time through your browser settings. Depending on your location, you may also have the right to opt out of ‘sale’ or ‘sharing’ of Personal Information for cross context behavioral advertising.
GPC / UOOM. We recognize and honor automated opt-out preference signals, including Global Privacy Control (“GPC”) and other [state-approved / legally recognized] Universal Opt-Out Mechanism (“UOOM”) signals, as required by applicable law. Consequences of Not Providing Information or Opting Out. You can choose not to provide certain information to us but it may delay or prevent us from providing our Services to you, including your ability to fully access our Site, participate in our Services, receive our newsletters, or similar features.
Categories of Personal Information Disclosed or Sold
Our Sale and Sharing Practices. We do not sell Personal Information to any third parties. We do not knowingly collect or sell Personal Information of consumers under the age of thirteen (13). In the preceding twelve (12) months, we did not sell any categories of Personal Information.[10]
Third Parties with Whom We Share Personal Information. In order to conduct our business and better serve you, we may disclose Personal Information and other information about you or your activities on our Site or while using our Services with:

Categories of Personal Information We May Share. The type of Personal Information we may share with others may include (a) your name and contact information, including your phone number, email address, and mailing address; (b) your payment card number (or other payment method) and related validation information; (c) information you provide when interacting with the Site; (d) website analytics information, including when, how often, and for how long you use the Site; information related to your geographic location; the content you submit and view; the name of the domain and host from which you access the Internet; and the IP address of the computer or device you are using; and (e) other identifiable information about you, such as date of birth, gender, age, and photographic images of you, including for purchases, exhibitions, commissions, or sweepstakes/contest entrants and/or winners.
Third-Party Independent Collection. Some third-party providers may independently collect Personal Information when you visit our Site. Our authorized third-party vendors and partners have their own privacy policies which govern the use, handling, and disclosure of your Personal Information.
Third-Party Analytics Services. We also may use third-party web analytics services on our Site, such as those of Google Analytics (see https://policies.google.com/privacy). The information collected may be used by Music Roadtrip and/or others in aggregated / anonymized formats to, among other things, evaluate use of the Site and relevant Services, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity. Marketing Correspondence and Advertising Partners
Email Marketing and Pixel Tracking. We may use third-party service providers or content to send or augment our marketing correspondence. To that end, we collect a variety of information about how users interact with our marketing efforts, including how many times an email is opened and/or clicked, the browser type used, operating system, user email program, etc. In addition, third parties that may assist with our marketing correspondence may use pixel tags that help us send the message in a format you can read, allow us to know which correspondence you act on, and to better target the content of future correspondence. We also use these tags to track the aggregate number of emails read and whether any of the links in the email were accessed.
SMS/Text Message Privacy. If you opt in to receive text messages from us, your use of the text messaging program and the information you provide in connection therewith, including your mobile phone number, is subject to this Privacy Policy. We will not sell, rent, or share your mobile phone number or SMS opt-in data or consent with any third parties or affiliates for their own marketing purposes.
Payment Processors
Payment processing via our Services is provided directly by us or by one or more third party payment processors as we may designate from time to time (“Payment Processor”). Music Roadtrip currently accepts payments via several Payment Processors, including PayPal (https://www.paypal.com/us/legalhub/privacy-full), Apple Pay (https://www.apple.com/legal/privacy/data/en/apple-pay/), and Google (GPay) (https://support.google.com/googlepay/answer/9039712?hl=en). [11] Music Roadtrip does not collect or store your payment card information. Your payment transaction data is stored only as long as is necessary to complete your transaction. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. For additional information, you can find out more about our Payment Processors’ privacy practices by visiting the websites of the applicable Payment Processor during a transaction. We are not responsible for our Payment Processors’ services, Privacy Policy, Cookie Policy, or Data Processing Agreement and you assume all related risks when interacting with such.
Retention, Confidentiality, and Security of Personal Information
Retention Periods and Criteria. We retain Personal Information for as long as is reasonably necessary for our business operations and to fulfill the purpose of collection or further processing as described in this Privacy Policy; as we determine is necessary for business records; and to comply with applicable law. In deciding how long to retain Personal Information, we consider many criteria, including the business purposes for which the Personal Information was collected, relevant federal, state, and local recordkeeping and personal data privacy laws, applicable statutes of limitations for lawsuits, claims or disputes to which the Personal Information may be relevant, and legal preservation of evidence obligations. Some Personal Information is deleted automatically after a set period of time, often set by law, unless we are legally required to hold it longer, such as for pending litigation.
Security Measures and Breach Notification. We restrict access to Personal Information to those who need to know in order to provide services to you and to conduct our internal operations. We maintain reasonable physical, electronic, and procedural safeguards to guard your information. However, the Internet and digital information is not absolutely secure and, thus, we cannot promise guaranteed security. In the unlikely event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you. As applicable, we will comply with notification requirements for a security breach and may also notify you using the email address you have provided to us.
NO WARRANTY. We make no warranty—express, implied, or otherwise—that we will prevent unauthorized access to or use of your Personal Information. If you do not agree to the collection, processing, storage, and transfer of your Personal Information, please do not provide your Personal Information or use our Services.
Business Transfers. In the event of a merger, acquisition, corporate change, or bankruptcy, we may share, sell, or transfer your Personal Information as part of a transfer of our assets to the acquiring entity.

Communications Compliance
Applicable Laws. We comply with all applicable federal and state telemarketing and consumer protection laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Telemarketing Sales Rule, and applicable state mini-TCPA statutes and state regulations.
Your Rights
Under state or international law, you may have certain rights. Please read below for information or options that may apply to residents of certain jurisdictions.
How to Exercise Your Rights; Verification Process. To exercise any of the rights described in this section (regardless of your jurisdiction), you or your authorized agent may submit a request by contacting us at info@musicroadtrip.com, 1910 Madison Ave #2421, Memphis, TN 38104, or by phone at 805.695.3168. We will verify your identity before processing your request by matching information you provide against information we maintain. You or your agent must provide sufficient confirmable identifying information for us to verify your request. In some states, you can designate an authorized agent to make a request on your behalf; if so, we may require written signed permission from you, proof of your identity, and verification of the agent’s identity. We will respond to verifiable requests within the timeframes required by applicable law, typically 45 days, with extensions as permitted. We will not discriminate against you for exercising any of your privacy rights. Please note that we are not required to respond to more than the legally permitted number of requests per calendar year, and certain information may be retained for recordkeeping, to complete transactions you began, or as required by law.
Users fromCalifornia
As we do not sell your Personal Information, there is no need to submit a request to opt-out.
We will not disclose your Personal Information to third parties for them to use for their direct marketing purposes unless you agree to us making that disclosure.
“Do not track”: Section 22575 of the California Business & Professions Code requires website and online service operators to disclose whether they honor web browser “Do Not Track” settings. Some browsers incorporate a “Do Not Track” (DNT) feature that, when turned on, signals to websites and online services that you do not wish to be tracked. Because there is not yet an accepted standard for how to respond to browser DNT signals, we do not currently respond to them. “Shine the Light” law: Effective January 1, 2005, under California Civil Code Section 1798.83, if an individual who is a California resident has provided Personal Information to a business in connection with a business relationship that is primarily for personal, family, or household purposes, and if that business has within the immediately preceding calendar year disclosed such an individual’s Personal Information to a third party and knows or should have known that such third party used the information for its own direct marketing purposes, then that business is obligated to disclose in writing to such individual upon request, what Personal Information was shared and with whom it was shared.
Additionally, certain visitors to our Site may have the following rights:

You have the right to not be discriminated against for exercising any of these rights. Please note that under this law, we are not required to respond to your request more than once in a calendar year, nor are we required to respond to any request that is not sent to the email or mailing address as noted herein.

International Data Transfers. Our Site is hosted in the United States and our Services are governed by United States law.
